Item 1 : Conditions of application
These General Conditions of Sale, hereinafter referred to as GTC, detail the rights and obligations concluded between E.A.R.L. GUETH JEAN-CLAUDE registered in the COLMAR Trade and Companies Register under number 415 081 124, hereinafter referred to as Domaine GUETH and the CUSTOMER (adults only). These conditions constitute the law of the parties.
They will prevail over all other general or specific conditions not expressly approved by Domaine GUETH.
Any order for a product from Domaine GUETH via the site www.vin-alsace-gueth.com implies acceptance without exception or reservation by the CUSTOMER of these T & Cs which will also apply to any other method of ordering between the parties.
The CUSTOMER declares before validating his order to have accepted these GTC. The order confirmation will be worth signature and acceptance of the operations carried out.
The T & Cs presented below apply to all Domaine GUETH products for distance sales in mainland France, excluding Corsica. Customers located outside mainland France should contact Domaine GUETH to determine the conditions under which sales could take place.
Before any transaction, the CUSTOMER declares to have full legal capacity, allowing him to commit himself under these T & Cs. As the sale of alcohol to minors is prohibited, the CUSTOMER who orders products agrees to be over 18 on the date of purchase. Alcohol abuse is dangerous for health. To consume with moderation.

Item 2 : Products – offers
The products offered for sale are those presented on the site www.vin-alsace-gueth.com within the limits of available stocks. In the event that a product is unavailable or a vintage is out of order after ordering, Domaine GUETH informs the CUSTOMER, either by email or by telephone within a maximum of 3 working days from receipt of the order. . A similar product or an equivalent vintage can be offered as a replacement.
The CUSTOMER must inform the GUETH Domain of his choice by mail or e-mail within five working days of the date on which he was informed of the unavailability of the products ordered.
If the CUSTOMER does not wish to receive an equivalent product, he may cancel his order, which will be refunded the price paid within fourteen days from the date of cancellation.
Domaine GUETH reserves the right to modify the product offer presented on its website at any time.
Each product is described and presented on the website in the form of a description detailing its essential characteristics, price indication and delivery costs.
All the texts and photos presented on the site are only indicative and are in no way contractual.

3.1. Order online on the website www.vin-alsace-gueth.com.
Placing an order requires the creation of a customer account on the site www.vin-alsace-gueth.com. The CUSTOMER must follow the order process specified therein by completing the dematerialized order form accessible online. Orders are received on the website www.vin-alsace-gueth.com using the dematerialized ordering procedure: Domaine GUETH confirms receipt of the order by e-mail. This confirmation is only made after payment of the price by the CUSTOMER. The order is then final and the sale is deemed to have been made, and can no longer be the subject of any cancellation or modification, without the prior written consent of Domaine GUETH, subject to the exercise by the customer of his right of withdrawal detailed in these GTC.
Payment within the meaning of this paragraph is the actual collection of the price including VAT and any shipping costs by Le Domaine GUETH.
The ordering procedure on the website is as follows :
a) The CUSTOMER selects the products he wishes to order by adding them to his basket.
b) Quantity discounts apply based on the total order amount.
c) If he has a promo code, the CUSTOMER must enter it in the field provided before confirming his order.
d) Any shipping costs are added to the order depending on the total amount of the order, specific offers in progress, and the place of collection or delivery.
e) The CUSTOMER is invited to create his account in the Shop of the site www.vin-alsace-gueth.com and register his contact details there. If his account already exists, he can directly connect to it by identifying himself with his username and password.
f) The CUSTOMER checks the delivery address. If this is different from the one recorded, he enters the new address in his customer account. The delivery address must be in mainland France (excluding Corsica).
g) The CUSTOMER chooses his method of payment: bank card, check or transfer.
h) The CUSTOMER checks all the information, reads and accepts these GTC by checking the corresponding box.
i) The CUSTOMER validates his order by clicking on the “Order” button. Confirmation of the order entails the unconditional acceptance or exception of these T & Cs. All the data provided and the recorded confirmation will constitute proof of the transaction. The CUSTOMER receives an order confirmation email. The fact of validating the order implies for the CUSTOMER the obligation to pay the indicated price.
j) For payment by credit card, the CUSTOMER is invited to safely fill in his credit card references (secure site).
k) An order acknowledgment is sent to the CUSTOMER on the e-mail address registered in his customer account.
For payment by bank transfer or check, the CUSTOMER prints his order confirmation received by email and the sending dated, signed and accompanied by his check or references of his transfer by post to the following address: Domaine GUETH – 1, Brunnmattweg – 68420 GUEBERSCHWIHR.
Only checks issued by a French Bank will be accepted. In case of payment by check or by transfer, the order will be shipped after receipt of the check or receipt of the transfer of the total amount including tax of the order and any shipping costs, without discount.
Special conditions: sale of gift cards
To be used as a code to spend in one go.
Period of validity: 365 days from the date of purchase.
In the event of a purchase amount made with the gift card lower than its nominal value, no refund of the difference will be made.
In the event of a purchase amount made with the gift card greater than its nominal value, the difference will be paid using another means of payment.

The CUSTOMER transmits his order via the desired means of communication: mail, email, telephone.
Payment methods accepted: check, bank transfer and payment by credit card. In case of payment by check or by transfer, the order will be shipped after receipt of the check or receipt of the transfer of the total amount including tax of the order and any shipping costs, without discount.
All checks must be sent by post to the address Domaine GUETH – 1, Brunnmattweg – 68420 GUEBERSCHWIHR, made out to the following order: E.A.R.L. GUETH JEAN-CLAUDE.
As part of a transfer, it must mention as a reference the name and first name of the CUSTOMER, as well as the date of the order.
Orders by mail, email, telephone imply acceptance of these T & Cs, without exceptions or reservations.
3.3. Billing

Invoices will be established by orders delivered and sent by e-mail within 24 hours of the order being dispatched to the CUSTOMER. Disputes relating to invoices must be reported by email to cave@vin-alsace-gueth.com within ten working days of transmission of the invoice. Otherwise, the complaint will be considered null and void.
b) Order via other means of communication
Invoices will be drawn up and attached to the shipment of the CLIENT’s order.
Disputes relating to invoices must be reported to cave@vin-alsace-gueth.com or by post within ten working days of transmission of the invoice. Otherwise, the complaint will be considered null and void.
Item 4 : Prices
The prices of the products appearing on the website www.vin-alsace-gueth.com are in Euros (€), all taxes included (VAT and other taxes applicable on the day of the order), glasses and packaging lost, for packaged products.
The prices indicated on the product sheets are from GUEBERSCHWIHR, excluding any shipping costs.

The CUSTOMER benefits from quantitative discounts from a certain purchase volume.

For a shipment to Corsica or to a country other than those mentioned, the CUSTOMER can consult the Domaine GUETH via the contact form on the site www.vin-alsace-gueth.com.
Domaine GUETH grants itself the right to modify its prices at any time. However, he undertakes to invoice the goods ordered at the prices indicated when the order is recorded.
Offers are always made subject to available quantities. In the event of unavailability of the goods ordered, the customer will be reimbursed for the sums paid by him, excluding any compensation or penalties, within 14 days of the date of rupture.
Item 5 : Delivery
The products are delivered by carrier directly to the CUSTOMER at the delivery address indicated during the ordering process which can only be in the agreed geographical area (Metropolitan France-excluding Corsica, Belgium, Luxembourg)).
Deliveries are made on the ground floor of the buildings. For mandatory delivery upstairs, please contact us.
Delivery times are only indicative; if these exceed thirty days from the order, the CUSTOMER may pronounce the automatic resolution of the sales contract and he will be refunded.
In the event of delivery by a carrier, Domaine GUETH cannot be held responsible for a delay in delivery due exclusively to unavailability of the CLIENT after several appointment proposals.
Once the order has been shipped, any change of delivery address must be the subject of a request confirmed by e-mail to cave@vin-alsace-gueth.com or by SMS to 06 08 26 43 34 and will be done. ” subject to additional invoicing.
Domaine GUETH would not be held responsible for an impossibility of delivery beyond its control, in particular due to the failure of the carrier, the absence of the CLIENT, an error of delivery address given by the CLIENT, an absence information on the conditions of access to the place of delivery (timetables, door code, etc.).

The CUSTOMER is required to check the condition of the packaging as well as the content of the package (s) on delivery and in the presence of the delivery person.
Item 6 : Complaints about delivery
The control of the packages is the exclusive responsibility of the CUSTOMER who must carry it out upon receipt and in the presence of the delivery person.
To be valid, any claim relating to breakage, damage, missing or theft problems of all or part of a delivery must be made at the time of delivery to the delivery person. The CUSTOMER must write his complaint in detail on the delivery note with his signature, and must collect a copy.
In the event of damage or breakage, the CUSTOMER must refuse the package (s) presenting problems. He must mention his complaint on the delivery note.
In the event of theft or missing items: the CUSTOMER must make reservations on the delivery note indicating the number of missing and / or received packages.
In all cases, the CUSTOMER must indicate these reservations in writing on the delivery slip with his signature and must inform Domaine GUETH by mail or e-mail of the reservations made, within 48 hours of delivery.
Item 7 : Withdrawal
Pursuant to article L121-21 of the Consumer Code, the CUSTOMER has a period of fourteen days from receipt of his order to exercise his right of withdrawal without having to justify reasons, nor to pay any penalties.
In execution of his right of withdrawal, the CUSTOMER may return part or all of the products ordered to Domaine GUETH, all return costs for these products being the responsibility of the customer. In the event of exercise of the right of withdrawal, Domaine GUETH will refund, as soon as possible and at the latest within 14 days of the date of receipt of the products subject to the right of withdrawal at the premises of Domaine GUETH, or the date on which the consumer has provided the Domaine GUETH with proof of the shipment of these products. This refund will be made via the same means of payment as that used when ordering.
Returns are to be made in their original condition and complete (packaging, protections, etc.), to the following address : Domaine GUETH – 1, Brunnmattweg – 68420 GUEBERSCHWIHR.
Returned products must be received by Domaine GUETH in perfect condition for resale. Any product that has been damaged or partially consumed may in no case benefit from the right of withdrawal provided for in this article. The responsibility of the CUSTOMER is engaged. Any damage suffered by the product (s) during the return may be such as to defeat the right of withdrawal: the CUSTOMER is advised to keep the original packaging until the end of the withdrawal period and not to damage the packaging when opening packages.
Item 8 : Guarantee
All the products sold by Domaine GUETH benefit from the legal guarantee provided for by articles 1641 to 1648 and 2232 of the Civil Code. Domaine GUETH also guarantees product compliance under the conditions specified in articles L 211-4 to L 211-13 of the Consumer Code.
If the CUSTOMER considers that the quality of the products delivered should be questioned (defect or hidden defect), he must notify Domaine GUETH in writing at the latest within fifteen days of receipt of said products. Domaine GUETH reserves the right to take back the goods concerned, to exchange them or to reimburse them. Domaine GUETH will only be able to take into consideration comments and complaints relating to wines purchased for less than one year.
In order to ensure the best conservation of the products delivered by Domaine GUETH, the CUSTOMER will undertake to keep the products sold in good preservation conditions: frost-free, in a temperate place, without sudden temperature variations, sheltered from light and rain, sun and any heat source.
Item 9 : Conditions for reimbursement or postponement of date for bed and breakfast and VIP formulas
Orders / reservations for guest rooms (nights in the bottles or VIP formula) may be subject to a cancellation request with reimbursement by the customer. or as the case may be, a date postponement depending on the date of the request. No proof is required to request cancellation or postponement.
- 100% refund if the request for cancellation is made at the latest 14 days before the date booked or postponed for a period not exceeding 12 months from the date of the order.
- 75% refund if the request for cancellation is made between 13 days and 7 days before the date booked or postponed for a period of 9 months, which may not exceed 12 months from the date of the order.
- 50% refund if the cancellation request occurs between 6 and 5 days before the date booked or postponed for a period of 6 months, which may not exceed 12 months from the date of the order.
- If the cancellation request occurs between 4 days and 3 days before the date booked, we only offer to postpone your stay within a period of 3 months, which cannot exceed 12 months from the date of the order.
- If the cancellation request occurs within 2 days before your stay, we do not offer any refund or postponement.
After a postponement, a refund request will be calculated on the basis of the amount of the order reduced by the non-refundable rate calculated after the successive postponement(s).
In the case of a reservation linked to a pre-paid gift voucher, the previous cancellation, refund and postponement rules apply with the restriction that the postponement may not exceed the initial validity period of the voucher (1 year from the voucher purchase date).
Gift vouchers are non-refundable and are valid for 1 year.
They may be exchanged for wines: the amount to be exchanged will be equal to the initial purchase of the voucher; this amount may be exchanged for bottles of wine from our estate, at the non-discounted price including any shipping costs.
A gift voucher not used within one year will be definitively lost.
Item 10 : Force Majeure and Liability
The responsibility of Domaine GUETH cannot be implemented if the non-performance or delay in the performance of one of its obligations described in these GTC results from a case of force majeure. Force majeure means any external, unforeseeable and irresistible event.
Item 11 : Retention of title
Domaine GUETH retains full ownership of the products sold until full payment of the price of the order..
Item 12 : Archiving and proof
Domaine GUETH will keep purchase orders and invoices on a reliable and durable medium which will constitute a faithful copy in accordance with the provisions of article 1348 of the Civil Code. The computerized registers of the GUETH Domain will be considered by the parties as proof of exchanges and communications, orders, payments and transactions between the parties.
Item 13 : Personal data
Domaine GUETH undertakes to guarantee the confidentiality of the information provided by the CUSTOMER. Information concerning him is subject to the provisions of Law No. 78-17 of January 6, 1978. The CUSTOMER has the right to access, modify and delete information concerning him. See also the page “Privacy policy”.
Item 14 : Applicable law and jurisdiction
These T & Cs are subject to French law which will govern any dispute relating to their interpretation and execution. The language of interpretation of these T & Cs is French.
In the absence of an amicable resolution, the competent court will be that of COLMAR (Haut-Rhin) for the resolution of disputes or litigation.
